This Disclaimer applies to the Tripkoz website, web dashboard and mobile applications operated by Tripkoz Technologies ("Tripkoz", "we", "us"). It forms part of, and is read subject to, our Terms & Conditions.
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement, to the maximum extent permitted by law.
2. What Tripkoz is not
Tripkoz is a record-keeping, tracking and communication tool. It is not:
- A transport operator. We do not drive vehicles, employ drivers, own fleets or carry passengers;
- A vehicle inspector or certifying authority. A completed checklist in Tripkoz is a record that someone said a check was done — it is not an inspection by us, and it is not a certificate;
- An emergency service, an alarm-monitoring service, or a dispatcher. No one at Tripkoz watches your alerts;
- An insurer, a broker, or a provider of any financial or insurance product;
- A legal, regulatory or compliance adviser. Nothing in the Service or on this website is legal advice.
Operating a safe transport service — licensed drivers, roadworthy insured vehicles, real inspections, working escalation procedures — remains entirely your responsibility.
3. Location, ETA and route information
Vehicle positions, routes, estimated arrival times and geofence events shown in the Service are indicative. They depend on GPS satellite availability, mobile network coverage, device battery and power settings, background-permission state, and third-party mapping data.
Positions may be delayed, imprecise, missing, or in rare cases wrong. An estimated arrival time is a calculation from imperfect inputs, not a promise.
Do not rely on the Service as the sole basis for a safety-critical decision — for example, deciding that a child is or is not on a vehicle, or that a vehicle has or has not reached a stop. Verify independently where the answer matters.
4. Alerts, notifications and SOS
Push notifications, SMS and email depend on networks and third-party providers outside our control. Delivery cannot be guaranteed to be immediate, or to happen at all.
An SOS raised in the Service is delivered to the contacts configured for that organisation. It does not reach any public emergency authority, and no one at Tripkoz is alerted to act on it.
A silent Tripkoz is not evidence that nothing has happened. The absence of an alert must never be treated as an all-clear.
5. Safety records and compliance
Safety checklists, inspection logs, document expiry reminders and maintenance schedules are aids to your own process. They record what your people entered.
We do not verify that a check was actually carried out, that a licence or fitness certificate presented is genuine or current, or that a record is truthful.
Records held in Tripkoz do not by themselves demonstrate compliance with any transport, labour, safety or data-protection obligation that applies to you. Meeting those obligations, and proving that you have, remains yours.
6. Third-party services and links
The Service depends on third parties — cloud hosting, mapping and geocoding, SMS and email gateways, push-notification services and payment gateways. Their availability, accuracy and pricing are outside our control and are governed by their own terms.
This website may link to third-party sites. We do not endorse, control or take responsibility for their content, products or privacy practices.
7. Website and marketing content
Descriptions of features, screenshots, sample data, figures and case examples on this website are provided for general information. Sample dashboards and map views use illustrative data, not real passenger or vehicle records.
We aim to keep this website accurate and current, but we do not warrant that it is free from error or omission. Features described may change, and availability may differ by plan.
Any performance figures, savings or outcomes mentioned are examples, not guarantees. Your results will depend on your fleet, your routes and how your team uses the Service.
8. Availability
We aim to keep the Service available continuously, but we do not warrant uninterrupted or error-free operation. Planned maintenance, third-party outages, network failures and events beyond our reasonable control can all interrupt access.
Any service-level commitment applies only where it is expressly stated in your plan or in a separate written agreement.
9. Limitation of liability
This Disclaimer does not extend the limitation of liability in our Terms & Conditions; it explains the circumstances that limitation was written for. Clause 17 of the Terms sets out the caps and exclusions that apply, and they apply to everything on this page.
Nothing here excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or wilful misconduct.
